In re West, 352 B.R. 905 (Bankr. M.D.Fla. 2006) – Court ruled in favor of our client being allowed to elect the more advantageous Federal exemptions, even though Florida law prohibits this. This case was a published decision, and not only affected Florida residents, but had nationwide significance.
In re Weeks Landing, 9:06-bk-01721-ALP – In construing the new bankruptcy law amendments, the Court ruled in favor of our client being granted an administrative claim and thus gaining highest priority treatment.
In re Fyock, 391 B.R. 882 (Bankr. M.D.Fla. 2008) – We established new legal precedent in Florida, in which the Court held that our client could both keep her home and also get an additional personal property allowance, in interpreting a recently-passed Florida statute. Prior to this decision, other Courts around Florida had ruled against homeowners regarding this new law.
