 Commercial
Trucks
When the manufacturer of a commercial truck
eliminates a known safety device from the
design of the truck and the truck user is injured
because of that absence of the safety device,
a successful claim can be made as against the
truck manufacturer.
In one such case, the truck manufacturer eliminated
a grab handle from the exterior of the cab. A
claim was made when the driver accidentally slipped
out of the cab and was run over by the wheels
of the truck. It was argued that a grab handle
could have prevented the incident.
A Hose from a commercial tuck used for cleaning
sewers was an issue in a claim, which was made
against the hose manufacturer when it exploded
in the face of the city employee while using
it to clean a sewer. The hose was negligently
manufactured. It had only been used several hours
and was being used well within the accepted rating
at the time of the explosion.
