Wrongful Death

A wrongful death claim is generally brought by family members after the death of a loved one caused by the negligence of another. It is generally an effort to recover damages for the emotional and financial injuries that the surviving family and/or estate have suffered due to the death of the victim

In Florida wrongful death cases, you generally have two years from the time of the decedent's death to file a lawsuit. In the case of medical malpractice, the statute of limitations may extend to four years.

Because of the nature of wrongful death suits, it is very important that steps are taken as quickly as possible to preserve evidence and witnesses’ memories of details etc.
