How can I prove medical malpractice?

The key to any medical malpractice case is the medical records. Step one is to obtain all pertinent medical records. Step two is to locate the appropriate similar healthcare provider who can act as an expert witness and review the medical records. That expert witness then makes a determination as to whether there was a breach of the standard of care by the defendant physician. And, if so, did that breach caused injury? If the answer to that is in the affirmative, then a medical malpractice claim can go forward. The defense inevitably will locate their own expert witnesses who will deny that there was a breach of the standard of care. And, then we have the classic battle of the experts. If anyone feels that they may have a medical malpractice claim, it’s critical that that individual seek out the appropriate counsel as soon as possible.
