Were you injured in Fort Myers, FL and have questions about car accident case timeline?

Check out this legal educational video to learn how long a car crash case can take in FL.

Question:

How long is it going to take to resolve my auto accident injury claim?

Answer:

The length of time that it takes to resolve your car accident case in Florida is dependent upon when you reach maximum medical improvement. That’s something that your doctors will be able to tell you. Secondly, a lot of it depends on whether the insurance company treats you fairly and whether we must litigate your case. If we must litigate the case, of course, it takes a bit longer, but it’s worth it in the end, because that’s what’s required to get you the compensation and justice that you deserve.

Question:

What does the auto accident litigation process entail?

Answer:

So, we first try to settle the case with the insurance company in pre-suit, by sending them a demand letter, demanding a certain amount of money if they're not being reasonable. If they do not respond favorably, then the case goes to lawsuit. So, our team files the lawsuit, and then we walk the client through the process. The process is: first we meet to answer some written questions. Next, you will then give a deposition, which is an oral statement to the defense attorney. Of course, one of our attorneys would meet with you before that to get you prepared and then be there at the deposition with you. We then take depositions of other witnesses or defendants, and then we go to mediation, which is where we sit down to try to attempt to settle the case with the defense attorney and a mediator. Then, if that does not settle the case, we would potentially take it to trial if that's necessary.

Question:

So, what are some things specifically that accident victims should look for in their personal injury attorney, in the litigation context?

Answer:

You should look for a trial attorney, and make sure that they are local here to Fort Myers, Cape Coral, Naples, Lehigh Acres or Port Charlotte. We have board-certified and civil trial attorneys here at Goldstein, Buckley, Cechman, Rice, Purtz, Smith & Smith. That means we have a trial expert on call. “I've tried a lot of cases, I can honestly tell every client that walks into the room when they meet me that I'm willing to try your case, if that's what you want.” states Chris Smith: Co-Managing Partner at Goldstein, Buckley, Cechman, Rice, Purtz, Smith & Smith. That attitude is a very important thing. Insurance companies know who the trial attorneys are. Insurance companies know that if it's a trial attorney, they're ultimately going to have to pay, or they're going to have to go to trial. And so, they keep track of that, and they pay more reasonably, when that's the case.

Question:

Will getting a trial attorney or lawyer affect the value of your case?

Answer:

Absolutely! You want an attorney that the insurance companies know will go to trial. That's going to get them to pay the fair value for the case. Client Reviews

Diana and Andrea were both amazing and my family and I could not be more grateful. I got into a bad car accident with our son and we contacted them right away, Diana was amazingly nice on our first meeting and made my family and I feel so comfortable. Our second meeting, which was the first with Andrea, our attorney, went great as well and she was extremely nice and understanding. They were very kind to change weeks if we were having a hard time getting there as well. I was also very happy with the communication….they were great to call and email me with any new information. Overall, could not recommend them anymore! I didn’t just feel like another number and that’s exactly what I was looking for when I came here, so thank you all so much!!
