In this particular case there was an employee mopping the floor during the middle of the day and didn’t have wet floor signs. There was one that was put in an aisle near where the person fell, and the defense argued, “Well, you can’t recover because there was a ‘Wet Floor’ sign,” and that’s not the truth. The defendant was negligent in that scenario. The plaintiff can also be found partially at fault.
