How Long Will a Medical Device Injury Claim Take to Resolve?

Answer:

There’s no stated or standard amount of time that it takes for a medical device injury claim to resolve in Florida, but because of the complexities of them and the fact that many times they end up in what’s known as multidistrict litigation and a central federal court somewhere in the country, they generally take anywhere from three to six years to resolve, but it could be less. We have a population down here in SW Florida where there are a lot of folks that are at this stage in their lives, where they're getting a knee replacement or a hip replacement, or some other medical device implanted in their body. Sometimes the implanted device it's causing the different metals or plastics, or whatever is inside the body to disintegrate. Obviously, that's a terrible thing, because you not only have to go through the surgery, but then you must go through another surgery to have that failed medical implant replaced.
