Question:

Do I have a lawsuit if my medical device that was implanted is recalled?

Answer:

If your medical device was recalled, that’s evidence that the device was defective, which can be used to support a claim of a defective medical device. It may depend, however, on the length of time the device has been in your body. Most microdevices have a life expectancy based on the state you live in at the time. If it’s somewhere between 10 and 15 years and the device has been implanted longer than that, then the fact it’s been recalled may not be relevant to support a claim; if it’s been less than that, then obviously, it will support a claim. The fact that the device has been recalled is strong evidence that the device is defective and therefore would support a claim for medical device.

Question:

How do I hire a personal attorney for a medical device defect that has gone bad?

Answer:

First of all, you need to know we here at Goldstein, Buckley work on a contingency fee contract, which means that you don't owe us anything unless we recover for you. We specialize in these sorts of cases, we take them in frequently. There are some super important details in cases like these that your attorney should know about. Some of these cases there are multi-jurisdictional groups set up to where if there's a lot of claims, then a judge will kind of oversee claims from many states and settle those claims. Because of this, you need to get your claim into these different setups timely to be able to make your claim. There's also some of them that will require class action lawsuits. We can guide you through that class action process. Lastly, make sure you vet the lawyer or attorney group you hire to take care of you. You need to look at the attorney's qualifications and ask them some hard questions:

  • Is this attorney board certified?
  • Has the attorney tried many cases?
  • Has the attorney or lawyers handled many cases like yours?
  • What's the size of the law firm?
  • Do they have enough staff to make sure your case moves quickly through the process?
  • Are they local to you?
  • Do they know the local SW Florida doctors?
  • Do they know the local and federal judges?
  • Are they held in high esteem?
