Other Driver Doesn’t Have Car Insurance
Do you know what common mistakes after a car accident claim to avoid?
Christopher J. Smith discusses mistakes that can ruin an auto accident case: see this video.
Question:
What are some common mistakes people make that can ruin their accident claim?
Answer:
The most common mistake that we see people involved in motor vehicle accidents make is: number one, talking with the insurance companies. The insurance companies do not always have your interests in mind. Whereas if you hire a personal injury attorney, they have your interests and your interests alone in mind and want to ensure that you are compensated for your damages. The second most important thing to consider is which lawyer you hire. You want to hire an attorney who specializes in personal injury and specifically motor vehicle accidents. Third, many people do not preserve EVERYTHING that they may have collected after the accident
1.) Why? You don't want to talk to the at-fault parties insurance company right away. They'll ask for a statement; don't talk to them. You'll want to talk to us first. We'll go over the car crash case with you. We will explain to you what should, and should not be said. We can really do all the corresponding with the insurance company for you, so you don't have to worry.
2.) You want an attorney who will be able to litigate and try your case if necessary. You need an attorney who understands personal injury and the system and is able to potentially try your case if needed. When there is no insurance for the at-fault driver things can get more complicated, let the local SW Florida lawyers at GBCLAW do the heavy lifting for you. We have been working with car accidents in SW Florida since 1962 and have the legal experience needed to get justice for you.
3.) Thirdly, you want to make sure that you have the appropriate documentation and photos for your claim. That goes back to hiring the right injury attorney because that attorney is going to make sure that everything is appropriately documented so that all of your damages can be presented to the insurance company, and then if necessary, to a jury. These are all things that, unfortunately, a lot of people don’t know until they’re involved in an accident. Save all paperwork that comes your way, take lots of photos at the scene, and take photos of any injuries you or a loved one may have sustained.
Question:
Why would my insurance company want to get involved even when the car accident is not my fault?
Answer:
We are in a no-fault state (Florida), meaning the first $10,000 in your medical bills are paid by your own insurance company. So that happens no matter what, even if you're not at fault. That's nice, because you're guaranteed to get that first $10,000 in medical care. The tricky thing is, after that first $10,000, the person at fault to the accident has responsibility for the rest. The insurance company has dedicated people for this, their whole job is to try to short you, and pay the least amount of money they can. It's a tricky situation with car accidents, and that's why you should really call an attorney right away.
Most don’t realize the importance of all this, but these things are all very important mistakes to try to avoid. One way to do that is to contact an injury attorney as soon as possible after the crash to get them involved and make sure someone is representing you and your interests throughout this process, because insurance companies do not do that. If you have any questions, we’re always happy to talk and answer any questions that you might have. GBCLAW is the best attorney near me.
