Yes, you can. The city has what's called sovereign immunity, meaning you can sue them for up to $200,000 in damages, for any injuries you sustained. Now, what matters really is the extent of that crack in the sidewalk or the defect in the sidewalk: is it enough for that to be considered an unreasonably dangerous condition? That's really where your attorneys come in. We have knowledge based on case law of what would be considered an unreasonably dangerous crack or deviation in the sidewalk. We can also call expert witnesses to get involved. After they review the situation, they can give their professional opinion and can state that the defect is what made the sidewalk unsafe for walking.
